By accessing or using UptimeMonitor Pro ("the Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

2. Subscription Terms

Our Service is billed on a subscription basis. You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis, depending on the subscription plan you select.

3. Payment Processing

Payment processing services for UptimeMonitor Pro are provided by Paddle.com Market Limited ("Paddle"). By subscribing to our Service, you agree to Paddle's terms of service. Paddle acts as the Merchant of Record for all our orders. All billing and payment inquiries should be directed to Paddle's customer service team.

4. Refund Policy

We want you to be satisfied with our Service. Our refund policy is as follows:

  • You may request a full refund within 14 days of your initial purchase if you are not satisfied with our Service.
  • For monthly subscriptions, refunds are available within the first 14 days of the initial purchase only. Subsequent months are not eligible for refunds.
  • For annual subscriptions, refunds are prorated based on the unused portion of your subscription if cancelled after the first 14 days.
  • Refund requests must be submitted through our support system or directly to Paddle.
  • Refunds will be processed through Paddle and will be issued to the original payment method.

5. Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, the Service with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

6. Account Terms

You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. You are responsible for all content posted and activity that occurs under your account.

7. Fair Usage

We reserve the right to implement fair usage policies to ensure the quality of service for all users. This may include reasonable limitations on API calls, monitoring frequency, and storage usage based on your subscription plan.

8. Limitation of Liability

In no event shall UptimeMonitor Pro, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Country], without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to update or change our Terms and Conditions at any time. If we make significant changes, we will notify you through the Service or via email.
